Terms of Service
Last updated September 2, 2026. The agreement that governs your use of LiveScan360 websites, software, hardware, and related services.
1. Agreement
These Terms of Service (“Terms”) are a contract between you and LiveScan360, Inc. (“LiveScan360,” “we,” “us,” or “our”), a Florida company based in Miami. They govern your access to and use of livescan360.com, our live scan software and dashboards, electronic submission services, hardware sales, quote and onboarding tools, the public TCN lookup, APIs, and related offerings (the “Services”).
By accessing or using the Services, requesting a quote, creating an account, submitting an onboarding form, or purchasing hardware or a plan, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization. A signed order, quote acceptance, statement of work, or enterprise agreement may add commercial terms. If there is a conflict, the signed commercial document controls for the subject it covers; these Terms control everything else.
2. Who may use the Services
The Services are intended for businesses, public agencies, and adults who are at least 18 years old and able to form a binding contract. You must use the Services only for lawful, authorized fingerprinting, background-check, licensing, or related purposes.
You are responsible for the acts of your employees, contractors, and operators who access your account, and for ensuring they are trained for the work they perform, including any CJIS or agency awareness your programs require.
3. The Services
LiveScan360 provides infrastructure and tools that may include, depending on what you purchase or enable:
- Capture software compatible with supported FBI Appendix F certified devices (currently RealScan-SG10 and RealScan-G10).
- Electronic packaging and transmission toward FDLE, FBI, and other supported channels using authorized ORIs and transaction types.
- Operator dashboards, status tracking, fee reference tools, and a public TCN status lookup that queries FDLE civil workflow status.
- Photo capture and other modules where an agency workflow requires them.
- Hardware sales, provisioning, and shipping of supported scanners.
- Optional APIs, file-conversion utilities, quotes, onboarding, and related support.
Features, agency coverage, and channel availability can change as programs and approvals evolve. Some pages on the website describe capabilities that are planned or pending approval. We do not promise that every listed agency, ORI, or module will be available to every customer on every date.
We may offer new features, beta tools, or regional limits. Beta or preview features are provided as-is and may change or end without notice.
4. Accounts and security
You must provide accurate account and registration information and keep it current. You are responsible for safeguarding credentials, workstation access, and any API keys, and for all activity under your account.
Notify us promptly if you suspect unauthorized access. We may suspend or limit access to protect the Services, other customers, applicants, or agency channels. You must not share logins in a way that bypasses role-based access or audit requirements.
5. Acceptable use
You agree that you will not:
- Use the Services for any purpose that is illegal or that violates FDLE, FBI, CJIS, or other agency rules.
- Submit fingerprint or identity data without an authorized purpose, valid ORI, and any consent the law or requesting agency requires.
- Falsify applicant identity, quality-control results, or transaction metadata.
- Attempt to access Criminal Justice Information or other records you are not authorized to see.
- Probe, scan, or load-test the Services or agency connections without our written permission; interfere with security or audit controls; or reverse engineer the software except to the extent the law does not allow this restriction.
- Resell, white-label, or provide the Services to third parties except as a permitted live scan provider under your agreement with us.
- Use the TCN lookup, fee tools, or APIs in a way that abuses, scrapes, or overloads them, or that is intended to harass an individual.
- Upload malware or content you do not have the right to use.
6. Applicant data and your responsibilities
If you capture or submit applicant information through LiveScan360, you are responsible for that collection. That includes giving applicants required notices, obtaining consent, using the correct ORI and purpose, keeping your site and staff compliant, and deciding how long to retain local copies you export to a workstation.
For applicant data processed in the platform on your behalf, you are the organization that determines the purpose of the live scan, and we process that data to provide the Services, to transmit to the agencies you designate, and to meet our legal and security obligations. You grant us a limited license to host, transmit, display to authorized users, and otherwise process that data solely for those purposes.
You represent that you have all rights and consents needed for us to process applicant information as described in these Terms and the Privacy Policy. You must not use the Services to collect data about children except as a lawful, authorized screening or licensing purpose with required adult consent.
7. Agency submissions and results
Electronic submissions are delivered to the receiving agency over supported channels. Processing times, holds, rejects, and results are determined by that agency, not by LiveScan360. We are not the Florida Department of Law Enforcement, the FBI, or any other reviewing authority, and we do not decide eligibility, hiring, licensing, or clearance outcomes.
You remain responsible for using current agency fee schedules, forms, and purpose codes. Published fee charts and ORI tables on our site are reference tools and can change when an agency updates them. Confirm amounts and requirements before you charge an applicant or submit a transaction.
8. TCN status lookup
The public TCN lookup is a convenience tool that checks the processing status of a Florida livescan submission against FDLE’s civil workflow source. It is not an FBI NGI or CJIS criminal-history result, not legal advice, and not a guarantee that an applicant is cleared.
Status text comes from the agency system and may be delayed, incomplete, or unavailable. If you need an official determination, contact the requesting organization or FDLE Applicant Services. We may rate-limit or disable the lookup to protect the Service and the upstream system.
9. Quotes, plans, fees, and taxes
Quotes, plan pages, and calculators are invitations to do business, not binding offers, until we accept an order or you accept a written quote in the manner we specify. Quotes are valid for the period stated on the quote (typically seven days) unless we say otherwise.
Subscription plans, pay-as-you-go scan pricing, provisioning fees, and hardware prices are as stated at checkout or on an accepted quote. Agency, state, and federal processing fees are pass-through amounts set by the receiving agency; we do not control those amounts and they may change.
Unless an order says otherwise, payment is due as stated on the quote or invoice. You are responsible for applicable sales tax, which we calculate from the U.S. shipping or billing address you provide. Late or failed payment may result in suspension of software access or a hold on shipment.
Except where the law requires otherwise, fees are non-refundable once Services have been provisioned or hardware has shipped, unless we agree in writing or a separate return policy applies to a defective device.
10. Hardware
We sell supported live scan devices (currently the Xperix RealScan-SG10) and related provisioning. Title and risk of loss pass to you when the carrier receives the shipment. Delivery windows (often two to four weeks after payment) are estimates and depend on manufacturer availability.
Hardware is subject to the manufacturer’s warranty. To the extent permitted by law, LiveScan360’s hardware obligation is to facilitate a manufacturer warranty claim or, at our option, repair or replace a device that arrives dead-on-arrival if you notify us promptly. You are responsible for suitable power, network, workstation, and physical security at the capture desk.
We support a limited set of existing devices for software use. Bringing an unsupported scanner does not create an obligation for us to integrate or certify it.
11. Availability and support
We aim to keep the Services available and to announce planned maintenance when we reasonably can. The Services may be interrupted by maintenance, agency outages, internet or hosting failures, force majeure, or security events.
Unless a separate written service level agreement says otherwise, the Services are provided without a specific uptime commitment, and planned or emergency maintenance is not a breach of these Terms. Support is provided during the hours and channels described on the site or in your order.
12. Intellectual property
LiveScan360 and its licensors own the software, site design, documentation, trademarks, and other intellectual property in the Services. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services during your subscription or other authorized term, solely for your internal live scan operations and in accordance with these Terms.
You retain ownership of your organization data and applicant records, subject to agency rules and the licenses you grant us in Section 6. Feedback you send us may be used to improve the Services without obligation to you.
You may not copy, modify, or create derivative works of the software; remove proprietary notices; or use our name or marks in a way that implies endorsement without permission.
13. Third-party services
The Services depend on third parties, including payment processors, communications providers, hosting, chat, and state or federal systems. Third-party terms and privacy policies apply to those services. We are not responsible for agency systems, carrier delays, or third-party outages outside our reasonable control.
Links to other websites, including applicant-facing scheduling on other domains, are provided for convenience. We do not control those sites.
14. Confidentiality
Each party may receive non-public business or technical information from the other. The receiving party will use that information only to perform under these Terms and will protect it with at least reasonable care. This duty does not apply to information that is public, independently developed, or rightfully received from another source, or that must be disclosed by law (with notice where legally permitted).
15. Disclaimers
THE SERVICES, INCLUDING STATUS LOOKUPS, FEE TABLES, DOCUMENTATION, AND BETA FEATURES, ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVESCAN360 DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that submissions will be accepted by every agency, that results will arrive within a particular time, that fee tables are complete at every moment, or that the Services will be uninterrupted or error-free. Manufacturer warranties on hardware are the manufacturer’s, not additional LiveScan360 warranties, except as Section 10 states.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVESCAN360 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, OR GOODWILL; LOST OR CORRUPTED DATA; COST OF SUBSTITUTE SERVICES; OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO LIVESCAN360 FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM. IF YOU HAVE PAID NOTHING, OUR LIABILITY IS LIMITED TO ONE HUNDRED U.S. DOLLARS.
These limits do not apply to liability that cannot be limited under Florida or other applicable law, such as certain personal-injury or willful-misconduct claims. Agency decisions, applicant outcomes, and third-party systems are outside our liability.
17. Indemnification
You will defend, indemnify, and hold harmless LiveScan360 and its officers, directors, employees, and agents from claims, damages, losses, and reasonable attorneys’ fees arising out of: (a) your use of the Services; (b) applicant data you submit or your failure to obtain required notices or consents; (c) your violation of these Terms or of law or agency rules; or (d) a dispute between you and an applicant, employee, or requesting organization.
18. Term, suspension, and termination
These Terms apply until you stop using the Services or we terminate them. Either party may terminate a subscription as stated on the applicable plan or order. We may suspend or terminate access immediately if you materially breach these Terms, fail to pay, create a security or compliance risk, or if the law or an agency requires us to stop providing a channel.
On termination, your license ends and you must stop using the software. Sections that by their nature should survive—including intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, and governing law—will survive. We will handle remaining data as described in the Privacy Policy and any data-processing terms.
19. Changes to the Services or these Terms
We may update the Services and these Terms. The “Last updated” date will change when the Terms change. If a change is material, we will provide additional notice when required, such as a site notice or email to the account contact. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Services and, if you have a paid plan, contact us about cancellation.
20. Export and government use
You must not use or export the Services in violation of U.S. export or sanctions laws. Software and documentation are “commercial computer software” and “commercial computer software documentation.” U.S. government end users receive only the rights granted to all other customers under these Terms.
21. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us and allowing 30 days to respond. If we cannot resolve it, exclusive venue for court proceedings is the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there—except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.
If you are a consumer and a law in your state requires a different venue or forbids a limitation in these Terms, that law controls to the extent it applies. These Terms do not limit rights that cannot be waived.
22. Miscellaneous
These Terms, the Privacy Policy, and any accepted quote or order are the entire agreement between you and LiveScan360 for the Services and supersede prior discussions on the same subject. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale. There are no third-party beneficiaries except as Section 17 describes. Notices to you may be sent to the email on your account or posted on the site. Notices to us should be sent through the contact form or to the address below.
